Can Bicyclist With Seven Week Erection Sue?

A man from Ireland had a seven week erection after a bicycle straddle mishap on the crossbar of his mountain bike. While many people, especially the elder and infirm may like the idea of a permanent hard on, this poor 22 year old did not.  So we ventured out to find a lawyer or solicitor to answer whether or not there was a lawsuit and no one would even give us the interview.

So we went across the pond to former Motherwell Scotland resident, and now California bicycle attorney, Michael Ehline for the answer. The facts relate that a 22 year-old Irishman endured the painful condition for five weeks before seeking medical assistance.  Doctors at the Tallaght Hospital in Dublin who treated the cyclist attempted to compress the erection for two weeks with a special dressing, which resulted as being only a temporary method of controlling the erection. As soon as the special dressing was remove the erection returned.

Doctors then blocked a blood vessel through a non-invasive process to relieve the bicyclist from the injury.
The biker made a full recovery and in one month reported there was no recurrence of the steady erection, though said there was satisfactory erection and intercourse. Doctors researching the harm the bicyclist suffered found there were two previous documented reports of straddle injuries that resulted in prolonged erection injury.
Doctors reported on the patient in the Irish Medical Journal, stating the man was a competitive biker, who suffered a “high-flow priapism” with a rigid erection, which occurs without sexual stimulation.

The 22 year-old had fallen with a leg on each side of the bicycle handle bar, which resulted in bruising, swelling and pain. This cleared up within days, but the unwanted erection continued and upon examination by doctors there was no sign of injuries or discomfort, other than embarrassment. Ehline says that “under California law, specifically, the Knight v. Jewett (1992) 3 Cal. 4th 296 [11 Cal. Rptr. 2d 2, 834 P.2d 696] case, a person assumes the risk of being injured when the mechanism of injury is inherent in the sporting activity. Here, Ehline says, falling off a back, or injuring your crotch area is a typical injury inherent in cycling.  Therefore, you could not sue the property owner for premises liability.”

But, Ehline says that the bicycle manufacturer, seat and handlebar makers could be sued, if there was a defect in the bike itself, if the facts bore out that the bike failed or broke, when used for its manufactured purpose withing the guidelines of use, or if there was inadequate warning of its weaknesses.  Without more facts Ehline says the man with the erection is left owing all these hospital bills himself.

The treatment that was successful involved inserting gel foam with four extremely small platinum coils at what is described as an abnormal connection between an artery and a vein that supplied the blood to the man’s penis.
Taillaght Hospital Dr. Ronan Browne said the treatment had great results for the man and the doctors were pleased with the final result. Browne said it was a distressing time for the young man, as it would be for any young man.

Dr. Browne said that the treatment was minimally invasive, but required a high level of expertise, since doctors had to insert a catheter, which is a flexible tube into the pelvic artery. When inserting the foam and coils into the artery, it carried a slight risk of impotence. The Tallaght Hospital doctor said that it had to be done right to avoid blocking off to much blood supply and using a more invasive treatment would have had a higher risk of impotence. Well, some would consider an erection a blessing, this rider did not, and at least under California law, he can’t even sue for recompense unless the bike caused the injury!

Tour de France Riders Hit Snag When Tires are Flattened

According to reports approximately 30 of the 50 front cyclists ended up with puncture holes in their tires, from tacks on Sunday. Defending champion Cadel Evans and Brad Wiggins, were two of the riders that ran over the box of tacks that were strewn across the road in the vicinity of the summit of Mur de Peguero.

This is the second of two category one climbs, and the 14th stage of the 191 kilometer route, and is the second to cause problems. The first event occurred last Saturday, when British rider Brad Wiggins, was struck by a demonstrators flare and suffered burns to his arm.  Race officials are asking police to investigate the incident that put as many as for tacks in one rider tires.

Race director Jean-Francois Pecheux on French television that the search for a culprit, would be nearly impossible, with the thousands of fans on the roadside at the time the incident happened. Sky Team requested that riders did not speed ahead, taking advantage of the misfortune of the approximately 30 riders that ran into the tack covered roadway.

The winner of this stage of the Tour de France was Luis Leon Sanchez, who with several other riders ahead of the pack, missed the sabotaged roadway.

Riding Your Bike in Michigan State and National Parks

Often, when I am riding across the different parts of the world, I find I get hurt in an accident, typically involving a passenger car, or a pothole. I like to find areas where there are less cars.  Often, I find resources online that help me with the issues I experience. Since I just flew in from Michigan, I wanted to chat with you a little about riding in the national parks, the state in general, and also, who you could call if you needed legal advice.  Here goes nothing: In Michigan, bicyclists are permitted to ride on all highways and roadways, except limited access freeways or unless otherwise posted. Bicycles are also allowed on all road systems including those in the State of Michigan forests, state parks, national forests, and national parks.

Many of the state and national trails in Michigan are suited for all-terrain bicycles and as a resource to our clients, our Michigan bike accident injury lawyers have provided the use of trails in these areas below (information provided by the Michigan Department of Transportation):

Bicyclists make up two percent of all victims in traffic accident annually. Group of Bicyclists Shot At in South Los Angeles

According to authorities a group of bicyclists were shot at in South Los Angeles with four of them sustaining injuries. Three of the bicyclists suffered injuries that they are expected to recover from and a fourth rider is listed in critical condition. Police stated the shooting incident occurred at approximately 11:15 p.m. on Thursday, November 5, 2011, resulting in the four cyclists being transported to area hospitals.

The shooting incident occurred at Long Beach and Vernon Avenues on the group of bicyclists that ranged in ages between 18 and their 20s. Police believed early in their investigation that the shootings on the group of bicycle riders could have been gang related and are still investigating. They have not identified or arrested the person responsible for the shootings of the bicycle group in South Los Angeles.

Malibu Bicycle Crash Fatal for Laguna Beach Bicyclist

November 7, 2011 – According to reports a bicyclist from Laguna Beach was killed in a Malibu crash. According to the California Highway Patrol a bicycle rider identified as a 51 year old Laguna Beach was killed in a bicycle collision.

The accident according to the California Highway Patrol occurred at approximately 11:45 a.m. Saturday on Las Flores Canyon Road in the vicinity north of Hume Road. According to the California Highway Patrol the bicyclist was riding on the wrong side of the road on a sharp curve when he struck a guardrail. The rider was thrown to the ground head first, causing him to suffer severe head injuries. The California Highway Patrol said that the man was wearing a helmet at the time of the crash and was transported to the hospital where he later died.

Collision Involving a Bicyclist Results in Serious Injuries

November 3, 2011 – When I ride, I always see accidents and close calls. Here is another one. According to reports a bicyclist was seriously injured in a collision with a Lexus. According to the California Highway Patrol that at approximately 12:47 p.m. Thursday a bicyclist was seriously injured when they were struck by a Lexus. The bicyclist was traveling southbound when struck while riding on Santiago Canyon Road at Lomas Peak Road.

Orange County Fire Authority Capt. Marc Stone the bicyclist, who was identified as a woman was wearing a helmet at the time she was struck by the Lexus. She was transported to Western Medical Center in Santa Ana.
According to the California Highway Patrol the driver and passenger in the Lexus remained at the scene of the crash, during the police investigation. I hope she makes it out ok.

Eighty-Five Year Old Flies into Shop Window

Arright Jimmy. So I was surfing Google today and I finds me this. Fucks sake, these yanks are fuck all crazy and daft sometime mon. On September 14, 2011, according to reports at the bicycle accident lawyers blog, an 85 year old woman crashed through a bicycle shop window Tuesday in Mission Viejo. According to Capt. Marc Stone of the Orange County Fire Authority the accident occurred Tuesday at approximately 5:00 p.m. in the 27800 block of Santa Margarita Parkway in Mission Viejo at the Rock N’ Road Cyclery.

Authorities stated the bike shop had customers and employees in the store when the 85 year old driving a 2001 Cadillac Deville crashed through the front window, traveling through the store and hitting the back wall. According to Lt. Gary Strachan, two people were struck by glass and a third person suffered a minor knee injury, who just had knee surgery. Lt. Strachan said the women and her granddaughter were in the vehicle and uninjured. The woman told investigators she was pulling into a handicapped parking space and accidentally hit the gas instead of the brakes. According to Capt. Stone customers and employees were shaken up, but there were no major injuries and there was no major structural damage to the building reported.

Bike Accident News out of the Dallas Area

Texas roads teach us the importance of sharing the road with bike riders and motorcyclists almost daily. Sadly, both bike and motorcycle injuries are commonplace in Dallas, Fort Worth and other cities, as many car drivers fail to keep a proper look-out for the said bikes. All it takes is one moment of bad timing or decision making to end the life of a motorcyclist, or at least change it forever. A female passenger on a motorcycle was killed in the Dallas-Fort Worth area last week after a collision with a car. Both lights at the intersection in Grapevine, Texas were yellow when the accident occurred. Another woman’s Dodge Charger attempted to turn left while she was westbound on Texas 26 onto Kimball Road when she crashed right into the male driver of the motorcycle and his female passenger. The motorcycle rider in question was flown to Parkland Memorial Hospital in Dallas, but his condition is unknown.
The police continue to investigate the collision and why the Dodge driver failed to yield to the motorcycle. It is extremely easy and common for drivers to make left turns into motorcyclists, because those turns require a driver to look extremely carefully. Many drivers simply do not see the motorcycles they turn into, because they unconsciously expect other cars. The name of the victim of this crash has not been released. Traffic was diverted for several hours after the wreck. The woman died of her injuries at John Peter Smith Hospital in Forth Worth. The driver of the car, a 20-year old woman, and her two passengers were also injured and taken to local hospitals.
